Bruno Calfat Advogados represented a large retail group in interlocutory appeals decided by the 4th and 13th Civil Chambers of the State Court of Rio de Janeiro, against mall.
The interlocutory appeals sought to overturn trial court decisions that imposed on the retailer the payment of astreintes (coercive daily fines imposed to enforce court orders) and contractual penalties, which together exceeded the amount of BRL 30 million.
The State Court of Rio de Janeiro upheld the arguments presented by the retailer in both appeals, granting them and significantly reducing the amount of astreintes and contractual penalties by 90% of the total previously fixed by the trial court.
Following the favorable rulings, the parties, represented by their lawyers, chose to terminate the litigation through a settlement agreement.
