The law firm Bruno Calfat Advogados represented a soccer club competing in Brazil’s first division in a legal proceeding recently decided by the Court of Justice of the State of Rio de Janeiro, which addressed the validity of the early termination of a sports sponsorship contract after the sponsor failed to make several required financial payments.
With the firm’s legal counsel, the Rio de Janeiro State Court of Justice accepted the soccer club’s arguments, concluding that the club had, for a certain period, fulfilled its obligations to display the sponsor’s brand on its game and practice uniforms, as well as on advertising signs, without, however, receiving the due consideration.
Thus, the soccer club was granted the right to terminate the contract based on its termination clause, with the sponsor ordered to pay all outstanding monthly installments.
