Bruno Calfat Advogados represented an engineering consortium contracted to perform services and supply materials and equipment for the sewage and stormwater drainage system of the Municipality of Macaé.
In this case, the Municipality of Macaé failed to make payments owed to the consortium for the services rendered and materials supplied, breaching contractual obligations and causing an interruption of the work, which led the consortium to file a collection lawsuit before the 2nd Civil Court of the Judicial District of Macaé.
After a favorable judgment recognizing the consortium’s right to receive BRL 30.6 million, the parties entered into a settlement agreement for BRL 45.6 million to close the dispute and enable the resumption of the work.
Despite the court’s approval of the settlement, the Municipality filed an appeal expressing its intention to withdraw from the previously agreed settlement.
The appeal was heard by the 20th Civil Chamber of the Rio de Janeiro State Court, which unanimously upheld the consortium’s arguments and denied the appeal, ordering the Municipality to comply with the settlement agreement entered into by the parties.
