Bruno Calfat Advogados represented a steel company in a public civil action (a type of lawsuit under Brazilian law, filed by public entities or associations to protect collective or diffuse interests, such as environmental or consumer rights) filed by the Federal Public Prosecutor’s Office (MPF), which sought to invalidate an administrative act issued by the environmental agency authorizing the regular operation of the largest steel plant in Latin America, located in the municipality of Volta Redonda.
The MPF filed an appeal against the decision issued by the 1st Federal Court of Volta Redonda, which had denied its request for an injunction to suspend the plant’s activities.
In response, the steel company submitted arguments opposing the appeal, which were fully upheld by the 6th Specialized Panel of the Federal Court of Appeals for the 2nd Region (TRF2). The court denied the MPF’s appeal, finding no irregularities in the environmental licensing procedures.
