Bruno Calfat Advogados represented an electricity distributor in a claim filed against the Municipality of Rio de Janeiro, seeking reimbursement for expenses related to the relocation of underground electrical infrastructure. The works were carried out in connection with the city’s 2016 Greater Tijuca Flood Control Plan, which aimed to address chronic flooding in the neighborhoods of Tijuca, Praça da Bandeira, and São Cristóvão.
Throughout the proceedings, the company presented documentary and expert evidence demonstrating that it undertook the relocation at the request of the city authorities and duly incurred the associated costs.
The ruling issued by the trial court in favor of the company, was upheld by the 5th Panel of Private Law of the Rio de Janeiro State Court (TJ/RJ), which accepted the company’s arguments and recognized the municipality’s obligation to reimburse the costs incurred in the relocation of the power grid, in the historical amount of R$ 7.5 million.
